This Privacy Policy explains how Shea Radiance, LLC (“Shea Radiance,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit our website, purchase our face, body, and hair care products online, or purchase our products through a retail partner, distributor, or physical store that carries our brand.

This Policy applies to customers located in the United States, Canada, and South America, which are the only regions where we currently sell and ship our products. We do not sell or ship products to customers located in Europe (including the European Union and United Kingdom), Australia, Africa, or any other region not listed above; if you place an order using a shipping address outside the United States, Canada, or South America, we will be unable to fulfill it. Where local law in the United States, Canada, or a South American country provides additional or different rights, the region-specific sections below apply in addition to the general provisions of this Policy.

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, whether online or through an authorized retailer that forwards your details to us (for example, for a warranty claim or rewards program), we collect the personal information you give us such as your name, address, email address, and phone number.

When you browse our store, we also automatically receive your computer's or mobile device's internet protocol (IP) address, along with information about your browser, operating system, and device, in order to help us learn about our visitors and improve our site.

Skin, hair, and body profile information: If you complete a product quiz, consultation form, or preference survey, we may collect information you choose to share about your skin type, hair type, concerns, allergies, or sensitivities, so that we can recommend suitable products. You are never required to provide this information, and we use it only to personalize recommendations and communications unless you tell us otherwise.

Order and fulfillment information: Because we manufacture our own products, order details (including product, batch/lot association, and shipping address) may also be shared internally between our e-commerce, manufacturing, and quality-control teams for order fulfillment, quality assurance, and product-safety tracking purposes.

Retail and wholesale purchase information: If you purchase our products from a third-party retailer, boutique, spa, or distributor, that retailer's own privacy policy governs the information collected at the point of sale. We only receive information you provide directly to us (for example, if you register a product, contact our customer care team, or enter a promotion).

Email marketing: With your permission, we may send you emails about our store, new products, and other updates.

SECTION 2 - HOW WE USE YOUR INFORMATION

We use the personal information we collect to: fulfill and manage orders, payments, returns, and exchanges; communicate with you about your order or account; provide customer support and respond to product-safety or adverse-reaction reports; personalize product recommendations; send marketing communications where you have consented or where otherwise permitted by law; improve our products, website, and services; detect and prevent fraud; and comply with our legal obligations, including product-safety and consumer-protection recordkeeping.

SECTION 3 - CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery, or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

SECTION 4 - COOKIES AND TRACKING TECHNOLOGIES

We and our service providers use cookies, log files, web beacons, tags, pixels, and similar technologies (“Cookies”) to operate our site, remember your preferences, measure site performance, and support advertising.

“Cookies” are data files placed on your device that often include an anonymous unique identifier. For more information about cookies, and how to disable them, visit http://www.allaboutcookies.org.

“Log files” track actions on the Site and collect data including your IP address, browser type, internet service provider, referring/exit pages, and date/time stamps.

“Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

You can manage cookies through your browser settings, including blocking or deleting them. Where we receive an opt-out preference signal, such as Global Privacy Control, from a browser or device you use to visit our site, we will treat that signal as a valid request to opt out of the sale or sharing of your personal information for that browser or device, to the extent required by applicable U.S. state law.

SECTION 5 - DISCLOSURE OF YOUR INFORMATION

We may disclose your personal information: to service providers who help us operate our business (payment processing, order fulfillment, shipping, manufacturing and lab partners, IT hosting, email/SMS marketing, customer support, and analytics); to retail, wholesale, and distribution partners solely as needed to support a sale, warranty claim, or product-safety matter you have raised with them or us; if required by law, regulation, legal process, or governmental request; to protect the rights, property, or safety of Shea Radiance, our customers, or others; if we are required by law to do so or if you violate our Terms of Service; and in connection with a merger, acquisition, financing, or sale of business assets.

SECTION 6 - SHOPIFY AND OTHER PLATFORM PROVIDERS

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify's data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, Shopify (or our other payment processors) stores your payment card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as necessary to complete your purchase transaction, after which it is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, a joint effort of brands including Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of payment card information by our store and its service providers.

SECTION 7 - THIRD-PARTY SERVICES

In general, the third-party providers we use will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies regarding the information we are required to provide them for your purchase-related transactions. We recommend that you read their privacy policies to understand how they handle your personal information.

Certain providers may be located in, or have facilities located in, a jurisdiction different from yours or ours. If you proceed with a transaction involving a third-party service provider, your information may become subject to the laws of the jurisdiction(s) in which that provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, your personal information may be subject to disclosure under United States law.

Once you leave our store's website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 8 - INTERNATIONAL DATA TRANSFERS

We are based in the United States, and the service providers described in this Policy may process your information in the United States, Canada, or the South American country from which you order, depending on where our systems and vendors operate. We take reasonable contractual and technical steps to protect personal information wherever it is processed. You may contact us using the details in Section 17 for more information about the safeguards we use for a specific transfer.

SECTION 9 - YOUR PRIVACY RIGHTS BY REGION

United States: Depending on your state of residence, you may have rights to know what personal information we have collected about you, to request deletion or correction, and to opt out of the sale or sharing of personal information or its use for targeted advertising. We do not sell personal information for money.

Canada (PIPEDA and provincial law): You have the right to access and request correction of your personal information and to withdraw consent to its collection, use, or disclosure, subject to legal and contractual restrictions. Our commercial electronic messages comply with Canada's Anti-Spam Legislation (CASL); every marketing email includes a way to unsubscribe, and we will honor opt-outs promptly.

South America: Where the data protection law of your country (for example, Brazil's LGPD, or similar laws elsewhere in South America) gives you rights to confirm, access, correct, anonymize, port, or delete your personal data, or to obtain information about with whom we have shared it, you may exercise those rights using the contact details in Section 17.

To exercise any of the rights described in this Section, contact our Privacy Compliance Officer using the details in Section 17. We may need to verify your identity before responding, and we will respond within the timeframe required by applicable law.

SECTION 10 - DATA RETENTION

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide our products and services, comply with tax, accounting, product-safety, and other legal obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purpose for which it was collected; when information is no longer needed, we securely delete or anonymize it.

SECTION 11 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed.

If you provide us with your payment card information, it is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption where applicable. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow PCI-DSS requirements and implement additional generally accepted industry standards.

If we experience a data breach that affects your personal information and triggers a legal notification obligation, we will notify you and, where required, the relevant regulator, in accordance with applicable law.

SECTION 12 - CHILDREN'S PRIVACY AND AGE OF CONSENT

Our site and products are intended for adults, and we do not knowingly collect personal information from children under the age of 13. By using this site, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have the consent of a parent or guardian to use this site. If we learn we have collected personal information from a child without appropriate consent, we will take steps to delete it.

SECTION 13 - PRODUCT SAFETY AND ADVERSE REACTION REPORTS

Because we manufacture cosmetic products for external use on the face, body, and hair, we may ask you for details about a reaction, irritation, or product-quality concern, including photographs, the product name and batch/lot number, and information about your skin, hair, or use of the product, in order to investigate the report, support any applicable regulatory reporting, and improve product safety. We use this information only for product-safety, quality-assurance, and regulatory-compliance purposes and will not use it for marketing without your separate consent.

SECTION 14 - MARKETING COMMUNICATIONS AND YOUR CHOICES

Where we send you marketing emails or text messages, we do so in compliance with applicable law, including the U.S. CAN-SPAM Act, Canada's Anti-Spam Legislation (CASL), and the applicable marketing laws of your country in South America. Every marketing email and text includes instructions for unsubscribing, and we will process opt-out requests promptly. Opting out of marketing does not affect transactional messages related to your order.

SECTION 15 - RETAIL AND OFFLINE PURCHASES

If you purchase Shea Radiance products at a retail store, spa, salon, or through a distributor, that business's own privacy practices govern any information it collects from you at the point of sale. This Policy applies to information you provide directly to Shea Radiance, for example when you register a product, contact us about a retail purchase, or participate in a promotion we run directly.

SECTION 16 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time, so please review it periodically. Changes take effect immediately upon posting to the website. If we make material changes to this Policy, we will provide additional notice (for example, by posting a notice on our homepage or, where required by law, contacting you directly).

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
