Shea Radiance, LLC (“Shea Radiance,” “we,” “us,” or “our”) manufactures and sells face, body, and hair care products directly to consumers through shearadiance.com and through authorized retail, wholesale, and distribution partners in the United States, Canada, and South America. These Terms and Conditions of Use (“Terms”) govern your use of our website and your purchase of our products online. We currently sell and ship only to customers in the United States, Canada, and South America. We do not sell or ship to customers in Europe (including the European Union and United Kingdom), Australia, Africa, or any other region.
1. Terms
By accessing this website, you are agreeing to be bound by these Terms, all applicable laws and regulations, and you agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these Terms, you are prohibited from using or accessing this site. The materials contained on this website are protected by applicable copyright and trademark law.
If you are a consumer in the United States, Canada, or a South American country that provides mandatory consumer protections that cannot be waived by contract, nothing in these Terms is intended to, or does, limit those mandatory rights, and these Terms apply to the fullest extent permitted alongside them.
2. Our Products, Manufacturing, and Intended Use
Shea Radiance formulates and manufactures its own face, body, and hair care products. Our products are cosmetics intended for external use only and are not intended to diagnose, treat, cure, or prevent any disease. Shea Radiance is not FDA-regulated as a drug manufacturer, and statements about our products have not been evaluated by the U.S. Food and Drug Administration or any equivalent regulator in another country.
Before first use of a new product, we recommend performing a small patch test on an inconspicuous area of skin and waiting 24-48 hours to check for a reaction. Discontinue use immediately and consult a healthcare professional if you experience irritation, an allergic reaction, or any adverse effect. Keep products out of the reach of children, avoid contact with eyes, and store as directed on the product packaging.
Product formulations, packaging, ingredient lists, and claims may vary by country to comply with local cosmetic-regulation requirements. Always refer to the ingredient list and instructions on the physical product packaging you receive, which controls over any general description on our website.
3. Use License
A. Permission is granted to temporarily download one copy of the materials (information or software) on Shea Radiance, LLC's website for personal, non-commercial, transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
A.1. modify or copy the materials;
A.2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
A.3. attempt to decompile or reverse engineer any software contained on Shea Radiance, LLC's website;
A.4. remove any copyright or other proprietary notations from the materials; or
A.5. transfer the materials to another person or “mirror” the materials on any other server.
B. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Shea Radiance, LLC at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession, whether in electronic or printed format.
C. You are welcome to submit suggestions, comments, reviews, or photographs. If you submit content, you grant Shea Radiance, LLC a non-exclusive, royalty-free, perpetual, irrevocable, worldwide right to use, reproduce, modify, publish, and distribute it in any media, together with any name or handle you submit alongside it. You represent and warrant that the content you provide is accurate and that you hold the necessary rights to it.
In use of gift messages and e-mailing a page to a friend, content cannot be obscene, threatening, defamatory, invasive of privacy, contain viruses, or amount to commercial solicitation, chain letters, mass mailing, or any form of “spam.”

4. Intellectual Property
The Shea Radiance name, logo, product names, packaging trade dress, and formulations are the trademarks, trade dress, and trade secrets of Shea Radiance, LLC or its licensors and may not be used without our prior written permission. Nothing in these Terms grants you any right, title, or interest in our trademarks, trade dress, or proprietary formulations, other than the limited license to view our website described in Section 3.
5. Orders, Pricing, and Payment
All orders placed through our website are subject to acceptance and availability. We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or product unavailability, and will notify you and issue a refund of any amount already charged if we cancel an accepted order.
Prices are listed in the currency shown at checkout and do not include applicable taxes, duties, or import fees unless stated otherwise. We take reasonable steps to ensure pricing is accurate but are not liable for typographical or technical pricing errors, and we may correct such errors and, where a payment has already been taken based on an incorrect price, cancel the order and refund you in full.
6. International Orders, Shipping, Customs, and Import Duties
We currently sell and ship only to the United States, Canada, and select countries in South America. We do not sell or ship to Europe (including the European Union and United Kingdom), Australia, Africa, or any other region. If you attempt to place an order using a shipping address outside the United States, Canada, or South America, we may cancel the order and refund any amount charged. Estimated delivery times, available shipping methods, and shipping charges are shown at checkout and vary by destination.
For orders shipped outside the United States, you are the importer of record and are responsible for any customs duties, import taxes (such as VAT or other applicable taxes), brokerage fees, or other charges assessed by your country's customs authority. These charges are not included in the item price or shipping cost and are collected either at checkout, on delivery, or by the shipping carrier. We are not responsible for delays caused by customs processing.
Because cosmetic products are regulated differently across countries, certain products, sizes, or ingredient formulations available on our U.S. site may not be available, or may be labeled differently, for shipment to Canada or South American countries.
7. Retail, Wholesale, and In-Store Purchases
If you purchase Shea Radiance products through an authorized retailer, boutique, spa, salon, or distributor rather than directly from us, that retailer's own terms of sale, pricing, and return policies apply to that purchase. These Terms govern only purchases made directly through shearadiance.com. If you have a product-safety concern or warranty question about a product purchased at retail, you may still contact us directly using the information in Section 17.
8. Returns, Refunds, and Right of Withdrawal
Our standard return and refund policy for online orders is available on our Returns Policy page. This policy applies to orders shipped to the United States, Canada, and South America, subject to any statutory exceptions that apply to opened or hygiene-sealed cosmetic products, which we will identify at the time of purchase. If the consumer-protection law of your country in Canada or South America provides mandatory return, refund, or cancellation rights beyond our standard policy, those mandatory rights apply in addition to, and are not limited by, our standard policy.
9. Disclaimer
A. The materials on Shea Radiance, LLC's website are provided “as is.” Shea Radiance, LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Shea Radiance, LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or on any linked site.
B. Shea Radiance, LLC is not FDA-regulated. All of our products are recommended for external use only and individual results may vary from person to person.
10. Limitation of Liability
In no event shall Shea Radiance, LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use of, or inability to use, the materials on Shea Radiance, LLC's website, even if Shea Radiance, LLC or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, and because some jurisdictions in Canada or South America do not permit the exclusion of liability for death, personal injury, or certain statutory consumer guarantees, these limitations may not apply to you to that extent.
11. Indemnification
You agree to indemnify and hold harmless Shea Radiance, LLC, its officers, directors, employees, and agents from any claim or demand, including reasonable legal fees, arising out of your misuse of this website, your breach of these Terms, or your violation of any law or the rights of a third party, except to the extent such claim arises from our own negligence, willful misconduct, or breach of applicable consumer-protection law.
12. Revisions and Errata
The materials on Shea Radiance, LLC's website could include technical, typographical, or photographic errors. Shea Radiance, LLC does not warrant that any of the materials on its website are accurate, complete, or current, and may change the materials at any time without notice, without any commitment to update them. We appreciate customer feedback if you find an error on the site and will correct mistakes with or without notice. We apologize, in advance, for any inconvenience caused.
13. Links
Shea Radiance, LLC has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of a link does not imply our endorsement of the site. Use of any linked website is at your own risk.
14. Dispute Resolution and Governing Law
Any claim relating to Shea Radiance, LLC's website or your purchase shall be governed by the laws of the State of Maryland, United States, without regard to its conflict-of-law provisions, except to the extent that mandatory consumer-protection or data-protection law of your country of residence in Canada or South America requires a different governing law or forum, in which case that mandatory law controls to that limited extent. If you are a consumer resident in Canada or a South American country, you may also be entitled to bring proceedings in, and rely on the protections of, the courts and consumer-protection laws of your own country of residence.

15. Force Majeure
Shea Radiance, LLC will not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, natural disaster, war, terrorism, labor dispute, pandemic, or disruption of shipping, customs, or supply chains.
16. Severability and Entire Agreement
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. These Terms, together with our Privacy Policy and any policies referenced in them (including our Returns Policy), constitute the entire agreement between you and Shea Radiance, LLC regarding your use of this website.
17. Site Terms of Use Modifications
Shea Radiance, LLC may revise these Terms at any time without notice. By using this website, you agree to be bound by the then-current version of these Terms.
